Exterior Concrete Limited Warranty

1. Limited Warranty:

This warranty is valid for one year, commencing from the pour date, covering defects in materials or workmanship.

2. Defective Materials:

Defective materials are defined as:

  • Major Concrete Cracks: See definitions in exclusions.
  • Failure in Supplied Concrete Design: This applies only when Joe & Sons Concrete is directly contracted (refer to Ready Mix Sales Conditions).
  • Concrete Vertical and Soffit Surfaces: These surfaces are to be smooth-form finished as per CAN CSA 7.9.2.6. (2014), excluding any patching of holes smaller than 1⁄2 inch on vertical surfaces.

3. Defective Workmanship:

Defective workmanship is defined as:

  • Improper Drainage or Slope: Concrete that holds water outside of flatwork finishing must meet CSA Class A "Conventional" FF20 FL15 standards (all smooth finish) or must not hold water beyond 5/16th of an inch.
  • Concrete Flatwork Finishing: Flatwork finishing must meet or exceed CSA Class A "Conventional" FF20 FL15 standards (all smooth finish) with 5/16th of an inch variance in flat surfaces only. Sloped, textured, and exposed surfaces are not included in this category.
  • Sub-Par Finishing Techniques: Any finishing techniques considered sub-par to industry standards, as confirmed by two independent and reputable consultants in the field of concrete finishing.

4. Exclusions:

This limited warranty does not apply to damage resulting from:

  • Abuse of Your Concrete: Misuse beyond the intended design.
  • Acts of God: Fire, flood, earthquake, defective subsurface, or other natural events such as weather-induced expansion and contraction.
  • Altering Nearby Areas: Alterations that affect drainage or water flow undermining your concrete.
  • Growth of Trees or Plants: Root growth near your concrete.
  • Scaling or Spalling
  • Post-Installation Contact: Contact between your concrete and vehicles, foreign objects, animals, or persons (other than contractors) during the 28-day curing period.
  • Non-Major Cracks: Cracks smaller than 1⁄4 inch due to compaction efforts, improper subgrade depths, or materials not defined in the contract.
  • Discoloration or Stains
  • Freeze-Thaw Cycles: Settlement or shifting from freeze-thaw cycles, and expansion or contraction from adverse heat.
  • Color Uniformity: Variations in color within the same pour or when repaired/replaced are not covered.
  • Base Material Failures: Failures due to base materials not installed by Joe & Sons Concrete Ltd.
  • Prep Work by Others: Any prep work completed by others negates all warranty items.

5. Notification of Warranty:

To activate a warranty claim, you must notify Joe & Sons Concrete within the one-year period.

  • Inspection: Upon notification, a representative from Joe & Sons Concrete Ltd will inspect the concrete to determine and investigate the cause.
  • Repair: If the cause is found to be due to defective materials or workmanship within one year of completion, the work will be repaired at no charge. Joe & Sons will determine the remediation effort.

6. Transfer:

There is no transfer of this warranty.

Maintenance:

Exterior Concrete Slabs & Care:

  • Avoid using salt, calcium chloride, fertilizers, commercially prepared de-icing chemicals, or any products that increase freeze/thaw cycles on concrete surfaces.
  • Freeze/thaw cycles can cause the concrete surface to flake or scale off, which is not covered by any warranty.
  • Proper curing and annual fall application of a concrete sealer is critical to reducing this damage.
  • For safety, Joe & Sons Concrete recommends using clean traction sand where conditions are icy.

Joe & Sons Ready Mix Sales Conditions

Joe & Sons Ready Mix Limited agrees to supply the material as quoted, in standard load quantities, on normal working days, during normal working hours, at the quoted unit price. Variations in the above, changes in specifications, or unloading delays may result in additional charges per Joe & Sons Ready Mix’s current price list, available upon request.

1. Specifications:

Our concrete is quoted and sold based on the most recent C.S.A. specifications. Any changes must be made in writing and signed by both Joe & Sons Ready Mix and the purchaser. Our concrete is not designed to be pumpable unless specifically stated on the submitted mix design. All strengths are designed to meet specified strengths (lab cured) in 28 days. We do not assume responsibility for the placement, finishing, or curing of a specified mix to a specific application or location.

2. Price Validity:

Prices and conditions must be accepted within 60 days of the quotation. Tax changes by Federal, Provincial, or Municipal Governments after the quotation date on any product or components of products listed herein will result in price changes to the extent of such tax changes.

3. Delivery Conditions:

Delivered price means materials are F.O.B. truck at the closest accessible point to the job site as determined by Joe & Sons Ready Mix personnel. The purchaser is responsible for any damage to municipal or private property resulting from crossing any municipal curb line.

4. Purchaser Responsibilities:

The purchaser agrees to be responsible for:

  • Providing sufficient notice of their requirements to enable Joe & Sons Ready Mix to comply, subject to prior commitments of machinery and equipment.
  • The addition of water or other substances to concrete after it has left Joe & Sons Ready Mix’s place of loading.
  • Payment for all materials ordered and later canceled unless sufficient time is given to cease the process of loading or manufacture without cost to Joe & Sons Ready Mix.
  • The cost of representation at Joe & Sons Ready Mix’s plant or destination for testing, checking, or designing any mixture of concrete components.
  • Preparation of job site ingress, egress, and positioning of materials.
  • Rejecting materials unless proof exists that the material did not meet agreed specifications, with Joe & Sons Ready Mix’s liability limited to the value of the material rejected.

5. Force Majeure:

Joe & Sons Ready Mix will not be responsible for delivery under the following conditions:

  • Events beyond Joe & Sons Ready Mix’s control, such as wars, riots, uprisings, natural disasters, strikes, lockouts, labor disputes, picket lines, or acts of God.
  • Breakdowns in machinery, equipment, or communications beyond Joe & Sons Ready Mix’s control.
  • Any situation where, in the exclusive opinion of Joe & Sons Ready Mix personnel, delivery could endanger life, machinery, or equipment.

6. Assignment:

This quotation or any resulting order is not assignable unless agreed to in writing by Joe & Sons Ready Mix.

  • Placing exterior slabs is not recommended when freezing conditions could occur within 28 days of the pour.
